Waiver and Release from Liability

By clicking the box at the bottom of this Waiver and Release from liability You expressly and voluntarily acknowledge and agree that:

A.        Inherent Risks of Skiing.  By purchasing and using a pair of Bluehouse skis, You will be engaging in a hazardous sport.  You expressly agree to assume the risk of and legal responsibility for injury, death, or loss to person or property that may result from the inherent risks of skiing, which include, but are not limited to, injury, death, or loss to person or property caused by changing weather conditions; surface or subsurface snow or ice conditions; hard pack, powder, packed powder, wind pack, corn, crust, slush, cut-up snow, machine-made snow, and avalanches; bare spots, rocks, trees, stumps, tree wells, and other forms of forest growth or debris; lift towers or other forms of towers and their components, either above or below the snow surface; variations in steepness or terrain including cliffs, whether natural or as the result of snowmaking, slope design, freestyle terrain, jumps, catwalks, or other terrain modifications; any other objects and structures, including, but not limited to, passenger tramways and related structures and equipment, competition equipment, utility poles, fences, posts, ski equipment, slalom poles, ropes, out-of-bounds barriers and their supports, signs, ski racks, walls, buildings, stairs, rails, bridges, and sheds; and plainly marked or otherwise visible snowmaking and snow-grooming equipment, snowmobiles, snow cats, and over-snow vehicles. 

B.         Mounting and Maintenance.  You agree that only qualified ski repair professionals will mount and adjust bindings on Bluehouse skis.  You are solely responsible for the maintenance and adjustments of your Bluehouse skis.  Injuries resulting from failure to properly maintain or adjust skis and bindings to Your body weight and performance level may result in serious injuries or death which risks You expressly agreed to assume in Section A above.

C.        Release of Claims.  In exchange for the opportunity to buy a pair of Bluehouse skis at a discounted price, You release and forever discharge Bluehouse Ski Co., LLC and its trustees, directors, officers, employees, contractors, volunteers, insurers, and all other persons from any and all claims which might arise from accidents, injuries or fatalities that may occur as a result of using Bluehouse skis. This release of claims includes, but is not limited to, those based on negligence, contract and/or breach of warranty.

D.        Covenant Not To Sue.  You agree not to sue or file any lawsuit, action,
arbitration or claim against the Bluehouse Ski Co., LLC if You or any third-party is physically injured or property is damaged as the result of or in connection with use of Your Bluehouse skis.

E.         Defense and Indemnity.  You agree to defend, indemnify, and hold Bluehouse Ski Co., LLC harmless from any and all claims or lawsuits brought against Bluehouse Ski Co., LLC  rising out of or in connection with the use of Bluehouse skis.

   1. Definitions. 

“Agreement” shall mean this Release and Waiver from Liability.

“You” shall mean the individual who is purchasing the Bluehouse skis or if the intended recipient of the skis is not the purchaser, the end-user of the product and shall include the purchaser or end-user’s parent(s) or guardian(s) if the purchaser or end-user is under 18 years of age.

IF I DO NOT AGREE TO THE ABOVE, I WILL NOT PURCHASE A PAIR OF BLUEHOUSE SKIS.
